WEEVE PRIVACY POLICY
This privacy policy (“Policy”) governs any end user’s use of the web-based application Weeve and the Kim chatbot (“Service”), any integrations, and websites that link to this Policy (collectively, “Services”). By accessing or using the Services, you agree to this Policy and our Terms of Services. This Policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Services.
The Service is designed for use in the United States. Information provided to us by you will be transferred to the United States and by using the Services you consent to the transfer, processing, and use of your information, including personally identifiable information, in accordance with this Privacy Policy.

The Information We Collect
The information we collect falls into two categories: information you actively provide (for example when you register for a company or create a new user), and information we collect through your use of our Services (for example we may have a legitimate interest to process your information for security, testing, maintenance, and enhancement purposes of the Services we provide to you, or for analytics, research, and reporting purposes). Without your information, we cannot provide you with the Services you have requested or you have you may be limited in your use of the Services.

Information You Provide Us

Accounts information. Some information is required to create an account on our Services, such as your name, email address, and password.

Communications. Requests or questions you submit to us via forms or emails (e.g., support forms) and your communications and dealings with us.

Participation. If you participate in any survey, SMS conversation, or research, we collect the information you submit.

Other services. We receive information when you choose to connect social media or other third party accounts and applications with your account, including a token to authenticate your identity between these accounts.

Other Users. We may receive information about you from other users, such as when they add you to our SaaS Services or invite you to use our Services.

Payment Information. We do not collect credit card information. Invoices are handled by third party services such as Wave, among others. We are not responsible for the policies and practices of such third party services.

Information We Collect Through Your Use of Services

When you use our Services including, but not limited to, when you access the Services via our websites, Weeve integrations, and Weeve software/applications, we collect certain including, but not limited to: (1) information about your interaction with the Services, including the actions you take on the Services and your interaction with other users, third party applications, and advertisements; and (2) device information, such as unique device identifiers, wireless service provider or mobile carrier, operating system information, IP address, browser type and language.

The Services may receive additional information about you from affiliates under common ownership and control, and from third parties, such as business partners, marketers, researchers, analysts, and other parties.

“Do Not Track” Settings. Because we track website usage information as described above, your selection of the “Do Not Track” option provided by your browser may not have any effect on our collection of certain information. The only way to completely “opt out” of the collection of information through cookies or other tracking technologies is to actively manage the settings on your browser to delete and disable cookies and other tracking/recording tools. However, getting a “Do Not Track” signal to work as you might want is difficult. Using browsers as an example, not all tracking technologies can be controlled by browsers; unique aspects of your browser might be recognizable even if you disable a tracking technology; not all settings will necessarily last or be effective; even if a setting is effective for one purpose, data may still be collected for another; and even if one website observes a “Do Not Track” signal, that website may not be able to control other websites.

We use this information for the purposes described below:

Analytics and Advertising. We work with partners who provide us with analytics and advertising services. This includes helping us understand how users interact with the Services, serving ads on our behalf across the internet, and measuring the performance of those ads. These companies may use cookies and similar technologies to collect information about your interactions with the Services and other websites and applications. We may also collect certain information through the use of cookies and other tracking technologies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the websites you visit.

How We Share Your Information
Weeve will share your information in the following ways:

Affiliates and Subsidiaries. We may share all information we collect within the Weeve family of companies.

Service Providers. We may provide access to or share your information with select third parties who perform services on our behalf. These third parties provide a variety of services to us, including without limitation billing, sales, marketing, provision of content and features, advertising, analytics, research, customer service, shipping and fulfillment, data storage, security, fraud prevention, payment processing, and legal services.

Third-Party Integrations. When you initiate a connection with a third-party integration through the Services, we will share information about you that is required to enable your use of the third-party integration through the Services.

Business Transfers. If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the Services can continue to operate. In such case, your information would remain subject to the promises and commitments contained in this Privacy Policy until such time as this Privacy Policy is updated or amended by the acquiring party upon notice to you. If such transfer is subject to additional mandatory restrictions under applicable laws, Weeve will comply with such restrictions.

Public Forums. The Services may make it possible for you to share comments or feedback publicly (i.e., outside of the Weeve web app or integrations) with other users, such as on the Weeve blog. Any information that you submit through such public features is not confidential, and Weeve may use it for any purpose (including in testimonials or other Weeve marketing materials). Any information you post openly in these ways will be available to the public at large and potentially accessible through third-party search engines. Such information can be read, collected and/or used by other users, and it could be used to send you unsolicited messages. Accordingly, please take care when using these features of the Services.

Aggregate/De-Identified Information. From time to time, Weeve may share Aggregate/De-Identified Information about the use of the Services, such as by publishing a report on usage trends. As stated above, this Policy places no limitations on our use or sharing of Aggregate/De-Identified Information.

Consent. We may also disclose your information to third parties with your consent to do so.

Legal Reasons. We may need to disclose your information to comply with a judicial proceeding, a court order, or any other legal process.

Your Choices
Your company’s Weeve administrator is responsible for maintaining, updating, or removing any personal information associated with your user within the Weeve suite of tools. We store information associated with your user for as long as the Company’s account is active or otherwise for a limited period of time as long as we need it to fulfill the purposes for which we have initially collection it, unless otherwise required by law.
You have the right to request access to the information we have on you. You can do this by contacting us at contact@weeve.ai.
We will make sure to provide you with a copy of the data we process about you. In order to comply with your request, we may ask you to verify your identity. We will fulfill your request by sending your copy electronically, unless the request expressly specifies a different method. For any subsequent access request, we may charge you with an administrative fee.
If you believe that the information we have about you is incorrect, you will need to contact your company’s Weeve administrator as they are responsible for updating and keeping your data accurate.

Children’s Privacy
The Services are intended for general audiences and not for children under the age of 13. If we become aware that we have collected personal information (as defined by the Children’s Online Privacy Protection Act) from children under the age of 13, we will take reasonable steps to delete it as soon as practicable. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at contact@weeve.ai.
How long we store your information
We will retain your information for the period necessary to fulfill the purposes outlined in this Policy.
How we protect your information
Weeve is concerned with protecting your privacy and data, but we cannot ensure or warrant the security of any information you transmit or guarantee that your information may not be accessed, disclosed, altered or destroyed despite any of our industry standard physical, technical or managerial safeguards. No method of transmission over the internet or method of election storage is 100% secure. However, the Services use commercially reasonable technical and organizational measures to protect your personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access.
California Privacy Rights
California law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined by applicable California law) with third parties for their direct marketing purposes. However, Weeve does not share your personal information with third parties for their own direct marketing purposes.
GDPR Requirements
1. Controller
Weeve services process Personal Data both as a Processor and as a Controller, as defined in the Directive and the GDPR:

The Service which you as a User entered an agreement with when using it, will be the Controller for User data, as outlined above in the ‘Information We Collect Through Your Use of Services’ section

The Services adhere to the Directive of 1995 and the GDPR from May 25th, 2018.
All data collected by the Services, either provided or through use of the platform, will be stored exclusively in secure hosting facilities provided by AWS. All hosting is performed in accordance with the highest security regulations.
2. International Privacy Laws
If you are visiting the Services from outside the United States, please be aware that you are sending information to the United States where our servers are located. That information may then be transferred without the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by us. These countries may not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage, and use of your Personal Data will be at all times continue to be governed by this Privacy Policy.

Changes to our Privacy Policy
We reserve the right to amend this Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. We will make the revised Policy accessible through the Service, so you should review the Policy periodically. If we make a material change to the Policy, you will be provided with appropriate notice and we will seek your consent to the updated Policy in accordance with legal requirements. By continuing to access or use our Services after those changes become effective, you are agreeing to be bound by the revised policy.
